Notice of Copyright Infringement

- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Important Caution: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including legal fees and court costs incurred by us or the alleged infringer. Do not submit a false claim if you are unsure whether you hold the legal rights to the material.
Counter-Notification Procedures
If you receive a notification from us that material you posted or purchased from our store has been removed or disabled due to a copyright infringement claim, and you believe this action was the result of a mistake or misidentification, you have the right to file a Counter-Notification.
To be effective, a Counter-Notification must be a written communication sent to support@dundays.com and must include the following details:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, physical address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to the jurisdiction of any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
Upon receipt of a valid Counter-Notification, we will forward it to the original complaining party. If the copyright owner does not file a court action seeking a restraining order against the content provider within 10 to 14 business days, the removed material may be restored to our website at our discretion.
Repeat Infringer Policy
In accordance with the DMCA and other applicable U.S. laws, Dunday’s Clothing Store has adopted a policy of terminating, in appropriate circumstances, users, accounts, or suppliers who are deemed to be repeat infringers. We also reserve the right to limit access to our store and terminate the accounts of any users who infringe the intellectual property rights of others, regardless of whether there is repeat infringement.
